Terms and Conditions
These terms and conditions ("Terms") constitute a legal agreement between you ("Renter," "you," or "your") and Europa Sailors Inc. ("Company," "we," "us,", “Europa,” or "our") for the rental of watercraft and related equipment ("Boat") for recreational purposes. By accessing our website, making a reservation, or renting a Boat, you acknowledge and agree to abide by these Terms.
Please read the following Terms carefully as they contain important information that affects your legal rights, remedies and obligations. In addition, these Terms contain various clauses such as limitations and exclusions, obligations to comply with the applicable laws and regulations of the country in which you operate or charter your yacht, and a clause governing jurisdiction and place of dispute.
Europa, is an online marketplace platform owner and operator. It provides connection between boat owners and guests. Europa cannot and does not control the content contained in any listings and the condition, legality, or suitability of any yacht chartering. The Company is not responsible for and disclaims any and all liability related to any and all listings and yacht chartering. Thus, any yacht charter will be made or accepted at the user’s own risk.
Renter acknowledges that they have provided accurate and up-to-date information during the reservation process. The Company does not accept responsibility for any missing or incorrect information provided by the Renter.
Europa, strictly prohibits the following activities:
Renter agrees to provide a valid identification document and, if required, a valid boating license or certification before the commencement of the rental period.
Renter must be of legal age and meet all necessary legal requirements to operate the rented boat.
Renter acknowledges that boating involves inherent risks and dangers, including but not limited to accidents, injuries, property damage, and unforeseen events. Renter assumes all risks associated with the use of the rented boat and agrees to operate the boat responsibly and in accordance with all applicable laws, rules, and regulations
The Company makes every effort to ensure that the rented boats are in good condition and well-maintained. However, the Renter acknowledges that the Company does not guarantee the absence of defects or malfunctions during the rental period.
The Renter agrees to inspect the rented boat before embarking on their journey and immediately inform the Company of any existing damage or issues.
The Company shall not be held liable for any damages, injuries, losses, or expenses incurred by the Renter during the rental period, including but not limited to accidents, collisions, theft, or equipment failure.
The Renter releases the Company from any liability arising from personal injury, property damage, or any other claims related to the use of the rented boat.
The Renter agrees to indemnify and hold harmless the Company, its affiliates, employees, and agents from any claims, liabilities, damages, costs, or expenses arising from the Renter's use of the rented boat, including but not limited to legal fees.
Security deposit is an amount collected during the rental process to cover possible damages, losses or additional costs. The deposit may be refunded or partially retained, subject to certain conditions, upon completion of the rental. The deposit also serves to compensate for the exemptions borne by the lessor. There will be losses and losses reflected in the lessor's deposit. The yacht has hull insurance at its original value. The deposit will be blocked from credit card at check-in or alternatively a cash deposit can be taken. Finalization of travel resignation and captain's liability insurance highly recommended, there is no accident insurance for people on the boat.
Reservations are subject to availability and confirmation by the Company. The Renter agrees to abide by the Company's cancellation policy, which will be communicated at the time of reservation.
The Company reserves the right to modify or amend these Terms and Conditions at any time. The Renter will be notified of any changes, and continued use of the boat rental service constitutes acceptance of the modified terms.
By engaging in the boat rental service provided by the Company, the Renter acknowledges that they have read, understood, and agreed to these Terms and Conditions.
